iBuyFlowers Terms & Conditions

Agreement Between User and iBuyFlowers
The iBuyFlowers Services include www.ibuyflowers.com, app.ibuyflowers.com, and related subdomains, landing pages, and online services operated by iBuyFlowers LLC (collectively, the “Services”). Your use of the Services constitutes your agreement to these Terms. Please read these terms carefully and keep a copy for your reference.
 
E‑Commerce Platform Description
iBuyFlowers LLC operates a digital trading platform that connects growers and suppliers directly with florists, event planners, and wedding planners in the United States. iBuyFlowers manages logistics, collects payments from buyers, and issues payments to growers and suppliers.
 
Privacy
Your use of the Services is governed by our Privacy Policy, which explains how we collect, use, and protect your information, including information processed through SMS/MMS/RCS programs. The Privacy Policy is incorporated into these Terms by reference and forms part of your agreement with iBuyFlowers. Information related to SMS/MMS/RCS messaging programs, including consent records, messaging preferences, and opt-out data, is processed in accordance with our Privacy Policy and applicable U.S. telecommunications, privacy, and consumer-protection laws.
 
Electronic Communications & SMS Consent
By accessing the Services, creating an account, placing an order, or voluntarily providing your mobile number, you may receive electronic communications from iBuyFlowers, including email and SMS/MMS/RCS text messages. Message frequency varies. Message & data rates may apply. Consent to marketing texts is not a condition of purchase. You may purchase products and use the Services without signing up for marketing text messages.

- Service-related texts may be sent based on your prior express consent.
- Marketing/promotional texts may be sent only with your express written consent.
You may opt out at any time by replying STOP. Reply HELP for assistance. Consent to marketing texts is not a condition of purchase.

All SMS/MMS/RCS messages sent by iBuyFlowers will clearly identify iBuyFlowers as the sender in each message, as required by applicable carrier and messaging regulations.

Text messages will be sent only during permissible hours in accordance with federal and state regulations based on the recipient’s time zone.

iBuyFlowers maintains records of your consent, including the date, time, and method of opt-in and any opt-out instructions, as required under federal and state law.

iBuyFlowers complies with all applicable U.S. carrier, A2P messaging, and 10DLC/The Campaign Registry (TCR) requirements. All SMS/MMS/RCS programs are registered with the appropriate carriers or registries, and message content is classified as transactional or marketing in accordance with applicable messaging regulations.

Types of Messages: Messages may include order confirmations, shipping and delivery updates, account notifications, customer support alerts, claims or substitution assistance, special offers, product announcements, seasonal promotions, and other service or marketing communications.

Your Account
You are responsible for maintaining the confidentiality of your account credentials. You agree that all account activity is your responsibility. The phone number you provide must be accurate and belong to you. Messaging preferences may be updated through our SMS Preferences Page.

By providing a mobile number, you represent that you are the owner or authorized user of that number and that you will promptly update your account if the number changes.
 
Links to Third‑Party Sites
The Services may contain links to third-party websites. iBuyFlowers is not responsible for the content, accuracy, or practices of any linked sites.
 
Use Restrictions / Intellectual Property
You are granted a non‑exclusive, non‑transferable, revocable license to use the Services. You may not:
- use the Services for unlawful activities
- modify, copy, reverse engineer, or distribute content without permission
All content is the property of iBuyFlowers or its suppliers and protected by applicable laws.
 
International Users
If you access the Services from outside the USA, you are responsible for compliance with local laws.
 
Indemnification
You agree to indemnify, defend, and hold harmless iBuyFlowers from any claims, losses, or damages arising from your use of the Services or violation of these Terms.
 
Arbitration Agreement
All disputes arising out of these Terms shall be resolved by binding arbitration under the Federal Arbitration Act. The arbitration will be administered by the American Arbitration Association. Judgment on the award may be entered in any court with jurisdiction.
 
Class Action Waiver
All disputes must be brought on an individual basis. Class, collective, or representative actions are not permitted.
 
Liability Disclaimer
The Services are provided “as is” without warranties of any kind. iBuyFlowers shall not be liable for any damages arising from use of the Services, to the maximum extent permitted by law.
 
Termination
iBuyFlowers may terminate or restrict your access to the Services at any time without notice.
 
Governing Law
These Terms are governed by the laws of the State of New York. You consent to exclusive jurisdiction in New York.
 
Entire Agreement
These Terms constitute the entire agreement between you and iBuyFlowers regarding use of the Services.
 
Changes to Terms
iBuyFlowers may update these Terms at any time. The most current version supersedes prior versions. Continued use of the Services indicates acceptance of updated Terms.

If we make material changes to our SMS/MMS/RCS messaging practices, we will provide notice through the Services or by text message when legally required. Continued participation in any messaging program following notice of changes constitutes acceptance of the revised terms.
