SMS/MMS/RCS policy

iBuyFlowers is trying to keep up working according to the latest TCR rules for SMS/MMS/RCS text messages standards

At iBuyFlowers, we use text messaging (SMS, MMS, and RCS (Rich Communication Services)) to communicate with our customers in compliance with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, The Campaign Registry (TCR) standards, and applicable U.S. state laws including Texas SB 140, Florida FTSA, and California privacy regulations. This policy explains how we collect consent, what types of text messages we send, and how you can manage your communication preferences.

1. Message Types
We may send two categories of text messages:

a) Service and Transactional Messages
These may include order confirmations, shipping and delivery updates, account notifications, support-related communications, and other messages necessary to complete or service your transactions. These messages are sent based on your prior express consent, meaning you voluntarily provided your phone number to receive them. Service messages never include marketing or promotional content.

All SMS/MMS/RCS messages include our brand name and required STOP instructions at appropriate intervals and comply with federal and state quiet-hour restrictions.

b) Marketing and Promotional Messages
These may include special offers, product announcements, seasonal promotions, and similar content. You will only receive these messages if you provide prior express written consent. Consent to receive marketing messages is not a condition of purchase.
Marketing messages are sent only during permitted hours under applicable laws, including but not limited to:
Texas SB 140: 8:00 a.m.–9:00 p.m. local time
Florida FTSA: 8:00 a.m.–8:00 p.m. local time
All messages include our brand name and required STOP/HELP information.


2. Use of Automation and AI
Some messages may be automatically generated or personalized using automated systems or artificial intelligence (AI). Automated tools may assist in sending timely service updates or relevant marketing communications, but they do not make decisions that produce significant or legal effects for you.
Automated messages are sent only from registered 10DLC or verified toll-free numbers in compliance with The Campaign Registry (TCR) requirements.


3. Opt-In and Consent
By opting in, you provide express written consent to receive SMS, MMS, and RCS messages from iBuyFlowers at the phone number provided. Consent may be collected through online forms, checkout flows, opt-in checkboxes, keyword responses (such as START or YES), or by submitting your phone number for order updates.
All consent records, including phone number, timestamp, and consent language, are securely stored for compliance.
At every point of opt-in, we disclose that:
Message frequency varies
Message and data rates may apply
Messages may be sent using automated technology
STOP/HELP instructions are available
You may revoke consent at any time by replying STOP or by contacting us through any reasonable means, including email or phone.
iBuyFlowers does not send SHAFT content (Sex, Hate, Alcohol, Firearms, Tobacco), in compliance with CTIA and carrier rules.

4. Opt-Out (STOP) and Help
You may revoke your consent at any time by replying STOP to any iBuyFlowers text message. After you send STOP, we will send one confirmation message. No further messages will be sent unless you re-subscribe.
We honor STOP variants including STOP, UNSUBSCRIBE, QUIT, CANCEL, and similar commands.

5. Message Frequency and Rates
Message frequency varies depending on communication preferences and order activity. Standard message and data rates may apply according to your mobile carrier.

6. Data Sharing
iBuyFlowers may share your phone number with our messaging providers (e.g., Sinch) solely to deliver SMS/MMS/RCS messages. We do not sell, rent, or share phone numbers for unrelated third-party marketing.

7. Compliance With State and Federal Laws
We strive to follow all applicable messaging laws and industry standards, including the TCPA, CTIA guidelines, The Campaign Registry (TCR) requirements, and relevant state regulations such as Texas SB 140, the Florida Telephone Solicitation Act (FTSA), and California privacy laws (including CPRA). Our practices are periodically reviewed and updated to align with current compliance expectations.

8. Policy Updates
iBuyFlowers may update this SMS/MMS/RCS Policy to reflect changes in messaging practices or legal requirements. If material updates are made, we will notify active subscribers by email or text before changes take effect.
